Terms of Service

1. The Basics

1. These are the rules for using aisanta.fun ("the Service"). Using it means you accept them.

2. The Service is run by: UPSIDE Dariusz Majewski ul. Św. Jadwigi Śląskiej 27, 43-300 Bielsko-Biała, Poland NIP (Polish tax ID): 5471980532 Below, "we" means the Service Provider.

3. Contact: contact@aisanta.fun.

4. Where we sell: the European Union, the USA, Canada, Australia, Japan, New Zealand, Singapore and Malaysia. If you order from outside that list, by VPN or by giving a false location, we may cancel the order and refund it in full. We are not liable for tax arising from a false location you gave us.

5. You must be an adult to create an account and order.

2. What You Are Buying

1. You write a message; we use AI to make a short video of Santa saying it.

2. Two things the AI gets wrong sometimes, so you know before you buy: unusual or non-English names may be mispronounced, and visual artefacts can appear anywhere in the picture. If something is wrong with your video, write to refund@aisanta.fun and see section 5 point 2. Your statutory rights over digital content — having it put right, a price reduction, or ending the contract — are unaffected (arts. 43m-43n of the Consumer Rights Act, implementing Directive (EU) 2019/770).

3. Everything happens online. You need an internet connection and a current browser.

3. What to Put in a Video

1. Use the Service legally and decently.

2. Do not enter anything that identifies the person the video is for.

A first name is enough. General details — their age, interests, what they are hoping for — are fine.
Never enter a surname, an address, a national ID or document number, health information, passwords, or card or bank details.

3. If you enter identifying details anyway, that breaks these Terms and we are not responsible for the data.

4. We will not generate unlawful, abusive, discriminatory, sexual or hateful content, and we can refuse an order or close an account for it. A refused order is refunded in full.

4. Paying

1. The price shown on the order summary is the price for that order. Prices include VAT where it applies.

2. We can change prices and run promotions, but never retroactively.

3. Payments go through Stripe.

4. The contract starts when you pay, and we start generating your video immediately.

5. Changing Your Mind, Refunds and Complaints

1. Under art. 38(1)(13) of the Consumer Rights Act you lose the 14-day right to withdraw when three things are true: you ask for digital content to be made immediately, you are told you are giving that right up and agree, and we confirm this on a durable medium. The checkout tickbox does the first two; the payment confirmation e-mail is the third, so keep it. Once generation starts there is no automatic cancellation.

2. If something goes wrong. If your video is not ready in the time we promised, we investigate and get it made as soon as we can; if we cannot make it at all, we refund you and tell you by e-mail. If there is a problem with a video we did deliver, write to refund@aisanta.fun and we will do our best to put it right. We do not promise to run it again — the same AI may do no better the second time — and we look at refunds case by case. None of this affects your statutory rights (section 2 point 2).

3. Complaints: e-mail refund@aisanta.fun saying what went wrong, with enough detail to find the order. We reply within 14 days, and usually within 24-48 hours for problems with a video.

4. Free videos: we do not guarantee availability, speed, or that an offer will return. You can still report a problem and we handle it under point 3 — there is simply no payment to refund. Your rights over content supplied without payment are unaffected.

6. When Things Break

1. We are not liable for outages caused by events outside our control, by failures at our payment, AI or hosting providers, or by necessary maintenance.

2. For Users who are not consumers, our liability is excluded as far as the law allows.

3. For consumers: we are not responsible for a typo you made in the name, or for a browser too old to play the video.

7. Who Owns What

1. The video is yours, for personal and non-commercial use.

2. We do not own the AI models — we use third-party services. What is ours is the Santa character and the Service itself. You get the video file and a licence to use it privately.

8. How Long We Keep Your Video

1. For 7 days after your video is ready you can download it from us. That is a promise about availability, not that no copy exists anywhere. Download it.

2. After 7 days it stops being available here. We delete the video files and the voice recording within 30 days at the latest. What you typed when ordering is kept for up to 90 days — see the Privacy Policy for details.

3. We cannot delete what has already left: a file you downloaded, or one taken from a share link you turned on. Sharing is your decision.

4. We may change the 7-day window in future.

9. If Something Goes Wrong (and the Legal Bits)

1. Tell us first: contact@aisanta.fun, or refund@aisanta.fun for a specific order or payment. We will do our best to put the problem right, and refund you if we cannot (section 5 point 2).

2. These Terms are governed by Polish law. We are established in Poland.

3. That does not remove the protections you have under the law of the country where you live (art. 6, Rome I). Where your law gives you more, you keep it.

4. Buying as a business: Polish law, and the court for our registered address in Bielsko-Biała.

5. Out-of-court routes for consumers in Poland: the district consumer ombudsman, or arbitration or mediation at the Provincial Trade Inspectorate — uokik.gov.pl. We are not obliged to take part and do not undertake to, but will consider any request.
